Cuban/Haitian Entrants

Certain immigrants from Cuba and Haiti have special status as Cuban or Haitian entrants. Not all people from Cuba or Haiti have this status. Some are admitted under other statuses, such as refugee or lawful permanent resident (LPR).

Cuban and Haitian entrants are those who are one of the following:

l  Paroled.

Cubans and Haitians who have been granted humanitarian parole are considered qualified noncitizens who are exempt from the five-year bar. (Federal law prohibits aliens who enter the United States on or after August 22, 1996, from receiving Medical Assistance for five years from the date of arrival, unless specifically exempt.)  

l  The subject of exclusion or removal proceedings.

l  Have an application for asylum pending.

Funding Source

Cuban and Haitian entrants are potentially eligible for federally funded health care (Medical Assistance with federal financial participation, or MinnesotaCare program LL, BB or FF) regardless of date of entry or length of time in the United States. They are also potentially eligible for Refugee Assistance Program funding. Cuban and Haitian immigrants who have been granted humanitarian parole are potentially eligible for federally funded health care if they meet all other eligibility criteria.

Status Adjustment

Consider people originally admitted as Cuban/Haitian entrants who later adjust to lawful permanent resident (LPR) status to remain Cuban/Haitian entrants for purposes of their health care eligibility.

Verification Requirements

Require one of the following forms of documentation of Cuban/Haitian entrant status:

l  USCIS form 551 with codes CU6, CU7, or CH6.

l  Unexpired temporary I-551 stamp in foreign passport or USCIS form I-94 with codes CU6 or CU7.

l  USCIS form I-94 with stamp showing paroled as Cuban/Haitian Entrant under Section 212(d)(5) of the INA.
