This section covers state residence for Medical Assistance (MA) for children in foster care. Some foster children remain residents of the placing state, while others become residents of the state where they live.
Federally Funded Title IV-E Placement.
Federally Funded Title IV-E Placement
The state in which the child currently resides is financially responsible for the child’s MA, regardless of whether another state has custody or placed the child out-of-state.
l Title IV-E foster care children placed in another state by Minnesota must be enrolled in MA in that state.
l Title IV-E foster care children placed in Minnesota by another states must be enrolled in Minnesota MA.
Coordinate opening and closing dates. If a IV-E funded child is placed out of state, leave MA open in Minnesota until the other state opens Medicaid for the child.
The state that places the child through the Interstate Compact on the Placement of Children (ICPC) is financially responsible for the child’s MA.
l If another state places state-funded foster care children in Minnesota under the Interstate Compact, the placing state remains responsible. The children are not eligible for MA in Minnesota.
l If Minnesota places state-funded foster care children in another state, Minnesota remains responsible for the children's MA.
Note: The Interstate Compact on the Placement of Children (ICPC) is an agreement among all 50 states that governs states' responsibility when sending children across state lines for the purpose of placement in foster care, adoptive homes, group homes and residential treatment centers.
