LTC Guardianship Fees (Archive)

Deduct the following fees actually paid by the client from the LTC income calculation:

l  Guardianship fees paid to a legally appointed guardian or conservator.

l  Representative payee fees paid to an appointed representative payee A person or organization, selected by the Social Security Administration, who is designated to receive benefits on behalf of an RSDI or SSI recipient and is obligated to use those benefits for the RSDI or SSI recipient's personal care and well being. authorized by Social Security.

Allow up to 5% of the client’s gross monthly income to a maximum of $100.

l  Allow up to the maximum for the total of all guardianship, conservator and SSA representative payee fees combined.

l  If the amount is less than the maximum, allow only the amount the client pays.

l  SSA or a court may allow a greater amount to be paid for these fees, however only allow a deduction up to the maximum.
