Manual Letter #37

This manual letter incorporates Bulletin #09-21-09 ”DHS Announces the Minnesota COBRA Premium Subsidy,” Bulletin #09-21-14 ”MinnesotaCare Fourth-Month Rule Waived for Former Minnesota COBRA Premium Subsidy Enrollees,” Bulletin #10-21-05 ”Changes to the Minnesota COBRA Premium Subsidy, ”Bulletin #09-21-11 ”Changes to Medical Assistance (MA) Estate Recovery, Special Needs and Pooled Trusts, and 2008 Legislative Enactment of Transfer on Death Deeds” and lists new and revised material for the Health Care Programs Manual. Unless otherwise noted, new and revised instructions are effective August 1, 2010.

Chapter 03 - Eligibility Groups and Bases of Eligibility.

A new section incorporates Bulletin #09-21-09 ”DHS Announces the Minnesota COBRA Premium Subsidy,” Bulletin #09-21-14 ”MinnesotaCare Fourth-Month Rule Waived for Former Minnesota COBRA Premium Subsidy Enrollees” and Bulletin #10-21-05 ”Changes to the Minnesota COBRA Premium Subsidy.”

Chapter 10 - Social Security Number.

Revisions to this chapter clarify policy for foster children and children receiving adoption assistance.

Chapter 13 - State and County Residence.

Updates clarify temporary absence for those living outside the U.S.

Chapter 15 - Third Party Liability.

Incorporates Bulletin #09-21-14 ”MinnesotaCare Fourth-Month Rule Waived for Former Minnesota COBRA Premium Subsidy Enrollees.”

Chapter 19 - Assets.

Incorporates Bulletin #09-21-11 ”Changes to Medical Assistance (MA) Estate Recovery, Special Needs and Pooled Trusts, and 2008 Legislative Enactment of Transfer on Death Deeds” and clarifications made to multiple sections. Additionally, a new section details methods of estate recovery.

Chapter 20 - Income.

Minor update clarifies allowable deductions for rental income.

Chapter 21 - Income Calculation.

Updates clarify the dependent care deduction.  

Chapter 23 - MA Payment of Long-Term Care Services.

Updates add information on the processing period and notification.

Chapter 28 - Obtaining Health Care Services.

A note added to this section clarifies access to services for enrollees temporarily out of the country.

Additions to this section incorporate Bulletin #09-21-14 ”MinnesotaCare Fourth-Month Rule Waived for Former Minnesota COBRA Premium Subsidy Enrollees”, explaining that the MinnesotaCare four-month rule does not apply to individuals and families who were enrolled in the Minnesota COBRA Premium Subsidy and whose COBRA coverage ended within the past four months.
