This section covers state residence requirements for General Assistance Medical Care (GAMC). These requirements apply to all GAMC applicants and enrollees. They do not apply to other programs.
To establish state residence, GAMC applicants must live in Minnesota outside of excluded time for 30 consecutive days with intent to remain in Minnesota permanently and not for a temporary purpose.
Exceptions:
n Migrant agricultural workers are not required to meet state residence requirements.
n A stay in a battered women’s shelter counts toward the 30 consecutive days.
Example:
Rose comes to a Minnesota battered woman’s shelter on April 10 from her home in Illinois. She intends to remain in Minnesota and applies for GAMC.
Action:
Consider Rose to be a Minnesota resident beginning on May 9, 30 days after she entered Minnesota. Coverage cannot begin before this date.
Example:
Robert enters a Minnesota treatment facility from his home in Iowa. He arranged his entrance to the facility on his own. Iowa did not place him. He does not maintain a home in Iowa and plans to stay in Minnesota when he completes treatment.
Action:
Robert is not a Minnesota resident while he resides in the treatment facility. He must reside in non-excluded time for 30 consecutive days before he can qualify for GAMC.
Do not apply the 30-day residence requirement in any of the following situations:
l A household member has a medical emergency as defined in EMA Basis of Eligibility.
l The county waives the 30-day residence requirement for the General Assistance cash program.
l A household member is a migrant agricultural worker who verifies that the household worked and earned at least $1,000 in Minnesota within 12 months before the month of application.
The $1,000 may have been earned from sources other than migrant work.
l Do not deny GAMC only because the client has not lived in Minnesota for 30 days.
l If the applicant has not yet lived in Minnesota for 30 days, but intends to stay, pend the application until the 30th day of residence.
l Deny the application immediately if there is a reason for ineligibility other than the 30-day residence requirement.
Verify state residence for GAMC. Sources of verification include but are not limited to:
l Copy of rental or lease agreements.
l Written statement from the client's roommate verifying the client's address and the date the client moved in.
l Rent receipt or written statement from a landlord, apartment manager, or homeowner stating that the client(s) reside at an address in Minnesota.
l Copy of Minnesota property tax statement or other proof of home ownership if the client owns the home.
l Utility bills in the client’s name at the current address.
l Copy of a valid driver's license, state identification or voter’s registration.
Note: A valid driver’s license is a license that is not expired, suspended, revoked or canceled. The license must contain the person’s current address. If the person moves, the address must be changed within 30 days. A Minnesota driver’s license is not valid if the person possesses a driver’s license issued by another state.
l Affidavit from a person engaged in public or private social services, legal services, law enforcement, or health services that states the person knows the recipient and believes the recipient resides in Minnesota.
l A completed Proof of Residence (DHS-6035A) form.
Verify intent to establish a home in Minnesota only if the information available is questionable.
