Introduction

Welcome to the Minnesota Department of Human Services (MDHS) Health Care Programs Manual (HCPM). The primary purpose of this manual is to provide policy information and instruction for county, tribal, and state staff who determine eligibility for Minnesota Health Care Programs.

This manual is designed to provide the reader with a general understanding of eligibility policy for Minnesota Health Care Programs. There are many legal authorities that govern the various health care programs, including but not limited to Title XIX of the Social Security Act, 42 Code of Federal Regulations Part 435, and Minnesota Statutes chapters 256B, 256L and 256D.03. In addition, the Department has obtained waivers of certain federal regulations from the Centers for Medicare and Medicaid Services (CMS). Because of the complex interrelationships among these sources, this manual does not attempt to identify the specific legal citations for each policy area.

The HCPM is divided into 30 chapters, each of which focuses on specific health care program eligibility requirements. These requirements may be technical or procedural (for example, citizenship) or financial (for example, income).

Unless otherwise stated, the policy for the Medical Assistance (MA) program applies to Noncitizens Medical Assistance (NMED), the Medicare Savings Programs, and the Home and Community-Based Services waiver programs.
