Exemptions from Asset Limits (Archive)

People who meet an exemption from asset limits do not have an asset limit for their own eligibility. Assets of an exempt person may be counted in determining eligibility for a spouse or sponsored immigrant because of asset deeming requirements.

Asset Limit Exemption - General Provisions

The following applicant/enrollees do not have an asset limit for any health care program:

l  Children under age 21, through the month of their 21st birthday. Children under age 21 do not have an asset limit, regardless of:

n  Whether they are applying as part of a household with members age 21 or older or applying separately.

n  Basis of eligibility.

l  Pregnant women, regardless of age, through the end of the 60-day postpartum period.

Example:

Annie and her husband Henry are applying for MA. Annie is pregnant. Henry is receiving RSDI disability benefits.

Action:

Annie does not have an asset limit because she is pregnant. Henry does have an asset limit. His asset total is calculated by totaling the sum of his assets along with the sum of Annie’s.

MA

In addition to the people listed in the General Provisions, the following applicant/enrollees do not have an asset limit for MA programs:

l  People who are eligible for automatic MA with MSA, RCA, GRH or IV-E foster care payments.

n  Assets will be reviewed based on the applicable cash program.

n  Do not apply the MA limits unless people are ineligible for cash and request MA only.

n  Do not apply the MA limits unless their MA eligibility is determined separately from cash. Examples include:

m MSA for personal needs in long-term care facilities.

m Elderly Waiver (EW) eligibility for Group Residential Housing (GRH) enrollees.

l  People receiving Transitional Medical Assistance (TMA) or Transition Year Medical Assistance (TYMA).

l  People with 1619(a) or 1619(b) status.

l  Women eligible for the Sage Screening Program.

l  People receiving care and rehabilitation services from the Center for Victims of Torture (CVT), who are not otherwise eligible for MA.

GAMC

In addition to the people listed in the General Provisions, the following applicant/enrollees do not have an asset limit for the GAMC program:

l  People who are eligible for automatic GAMC with GA.

n  Assets will be reviewed based on the applicable cash program.

n  Do not apply the GAMC limits unless people are ineligible for cash and request GAMC only.
