23.40.35ar1 - LTC Court-Ordered Child Support (Archive) |
Archived: October 1, 2008 |
Deduct court-ordered child support paid by the client from the LTC income calculation.
l The payments must be garnished from income in order to be used as a deduction.
Note: It is not uncommon to see court-ordered child support garnished from RSDI payments.
l The payments can be for arrearages, current support or both.
l Allow up to a maximum of $250 per month of payments remaining after allocations to the children have been completed, regardless of the number of children the client is supporting.
Note: Each child is entitled to an allocation, which should be calculated before applying the child support deduction. See LTC Family Allocation for information on calculating the child’s allocation amount.
