Bulletin #06-21-09C, Citizenship and Identity Documentation Requirements for Certain Minnesota Health Care Programs Applicants and Enrollees and Bulletin #07-21-01, Changes and Clarifications for Citizenship and Identity Documentation

The following sections were updated with information from bulletin #06-21-09C, which was effective August 1, 2006, and bulletin #07-21-01, which was effective as of the bulletin’s March 9, 2007 issuance.

Chapter 03 - Eligibility Groups and Bases of Eligibility

All of the following chapter 03 updates are noted under "Citizenship and Immigration Status" in each section.

n  Section 03.20.10, MinnesotaCare for Auto Newborns.

n  Section 03.25.10, MA for Auto Newborns.

Adds information from bulletin #06-21-09C, noting that documentation of U.S. citizenship for auto newborns should be obtained as soon as it becomes available (rather than waiting for the next renewal).

n  Section 03.20.05, MinnesotaCare for Pregnant Women.

n  Section 03.20.15, MinnesotaCare for Children Under 21.

n  Section 03.20.20, MinnesotaCare for Adults With Children.

n  Section 03.25.15, MA for Children Under 21.

n  Section 03.45.15, Center for Victims of Torture (CVT).

Makes minor wording changes to clarify whether policy pertains to U.S. citizens or noncitizens (for example, "immigration status" instead of "citizenship," or "children who are noncitizens" instead of "children").

n  Section 03.20.25, MinnesotaCare for Adults Without Children.

n  Section 03.50.05, GAMC with Full Benefits.

Adds information from bulletin #06-21-09C that documentation of U.S. citizenship and identity is not a condition of eligibility for these clients. Also clarifies that clients who are otherwise eligible for MA or federally funded MinnesotaCare but fail to document U.S. citizenship and identity are not eligible for state-funded MinnesotaCare or GAMC.

n  Section 03.25.20, MA for Children in Foster Care.

n  Section 03.25.25, MA for Children Receiving Adoption Assistance.

Adds policy update from bulletin #07-21-01 that children receiving foster care or adoption assistance benefits are exempt from U.S. citizenship and identity documentation requirements. Also clarifies that, for foster care, this exemption pertains to benefits that are either IV-E or state-funded.

n  Section 03.35.05, Qualified Medicare Beneficiary (QMB).

n  Section 03.35.10, Service Limited Medicare Beneficiary (SLMB).

n  Section 03.35.15, Qualified Individuals (QI).

n  Section 03.35.20, Qualified Working Disabled (QWD).

Adds information from bulletin #06-21-09C that people who are enrolled or eligible to enroll in Medicare are exempt from U.S. citizenship and identity documentation requirements.

n  Section 03.45.30, MA for Breast/Cervical Cancer (MA-BC).

n  Section 03.45.35, Minnesota Family Planning Program (MFPP).

Adds information from bulletin #06-21-09C, clarifying that documentation of citizenship and identity is not a condition of eligibility during the presumptive eligibility period.

Chapter 09 - Verification Requirements

n  Section 09.05, Mandatory Verifications.

Under ”Verification - All Programs,” clarifies who must verify U.S. citizenship. Replaces information about who is exempt from this requirement with a link to section 11.05, Verification of U.S. Citizenship.

n  Section 09.10, Verification Documentation.

Under ”General Documentation Provisions,” removes the statement, ”Any form of documentation is acceptable if it confirms the client’s statement,” which does not apply to U.S. citizenship and identity documentation requirements. Also removes a statement about specific income verification for MinnesotaCare that is already noted in the Income chapter, and rearranges the remaining text.

Under ”Special Photocopying Requirements,” adds information about copying Certificates of Naturalization for verification of citizenship.

Under ”Related Topics,” adds links to several sections.

n  Section 09.15, Obtaining Verifications.

Under "State Verification and Exchange System," adds statement from bulletin #06-21-09C that SVES may be used to confirm or verify citizenship for SSI and MSA recipients.

Chapter 11 - Citizenship and Immigration Status

n  Section 11.05, Verification of U.S. Citizenship.

Adds information from bulletin #06-21-09C, expanding on who is or is not required to verify U.S. citizenship, who is exempt from this requirement, and when documentation must be provided.

Adds policy update from bulletin #07-21-01 that people who receive SSI, RSDI due to disability, or foster care or adoption assistance benefits are exempt from this requirement. Further clarifies information from bulletin #07-21-01 to include state-funded as well as IV-E foster care benefits.

n  Section 11.05.05, Acceptable Documentation of U.S. Citizenship and Identity.

This new section adds information from bulletin #06-21-09C about the hierarchy of documentation; requirements for original documents or copies; why identity documentation is part of this requirement; the different levels of U.S. citizenship documentation; obtaining documentation through birth records; and obtaining documentation for clients who were previously enrolled in another state.

n  Section 11.05.10, Process for Documentation of U.S. Citizenship and Identity.

This new section adds information from bulletin #06-21-09C about the process of requesting documentation, case record and case note requirements, and transfer and retention of documentation.

Adds expanded information from bulletin #07-21-01 about checking the case record before requesting documentation, and the request process.

n  Section 11.05.15, Cooperation with Documentation Requirements.

This new section adds information from bulletin #06-21-09C that defines failure to cooperate with this requirement; how the MinnesotaCare All or Nothing Rule applies to this requirement; and how to refer a case to HealthQuest.

Adds policy update from bulletin #07-21-01, defining when health care coverage should be denied or closed for failure to cooperate with this requirement.

Chapter 17 - Household Composition

n  Section 17.10.15, All or Nothing Rule.

Adds information from bulletin #06-21-09C that explains how to apply the All or Nothing Rule to U.S. citizenship and identity documentation requirements.

Bulletin #07-21-02, DHS Announces Changes to Medical Assistance (MA) and MinnesotaCare Eligibility for Continuing Care Retirement Community (CCRC) Residents Regarding Entrance Fee as an Asset

The following sections were updated with information from this bulletin, which was effective April 1, 2007.

Chapter 09 - Verification Requirements

n  Section 09.05, Mandatory Verifications.

Adds that CCRC entrance fees must be verified for MinnesotaCare.

Chapter 19 - Assets

n  Section 19.15, Availability of Assets.

Adds a new subsection about consideration of CCRC entrance fee availability.

n  Section 19.20, Verification of Assets.

Updates asset verification requirements. Verification of assets for MinnesotaCare is only required when a CCRC entrance fee may be available.

n  Section 19.25, Asset Types.

Adds CCRC entrance fees to the list of specific types of assets.

n  Section 19.25.45, CCRC Entrance Fee.

This new section adds policy explaining Continuing Care Retirement Community (CCRC) entrance fees, and when they may be considered a countable asset for MA or MinnesotaCare eligibility. A CCRC is an organization that offers a range of continuing care services (such as housing, medical services, or home health care) which may change with the client’s needs.

n  Section 19.25.45.05, Minnesota CCRCs.

This new section lists the registered CCRCs in Minnesota (currently only in Hennepin and Olmsted counties).

Bulletin #07-21-03, Changes and Clarifications to Minnesota Family Planning Program (MFPP) Announced

The following sections were updated with information from this bulletin, which was effective as of the bulletin’s March 26, 2007 issuance.

Chapter 03 - Eligibility Groups and Bases of Eligibility

n  Section 03.45.35, Minnesota Family Planning Program (MFPP).

Deletes a sentence under ”Eligibility Method” stating not to exclude dependent child Income. The Method A dependent child income exclusion now applies to the MFPP.

Adds under ”Other Requirements” that if a caretaker enrolled in the MFPP fails to cooperate with medical support requirements for children enrolled in MA or MinnesotaCare, the IV-D agency will notify the child’s worker. The MA or MinnesotaCare worker will contact the DHS MFPP unit to coordinate closing MFPP.

n  Section 03.45.35.05, Application Process for MFPP.

Adds that providers who determine presumptive eligibility will now give the form ”Giving Someone Permission to Act on My Behalf” (DHS-3437A) to applicants who want an authorized representative. The MFPP application no longer includes the authorized representative question.

Deletes references to the obsolete MFPP Presumptive Eligibility Approvals form (DHS-4774). Instead of completing and faxing this form to DHS, providers will now complete the ”Provider Use Only” boxes on page one of each MFPP application (DHS-4740) approved for presumptive eligibility and fax it to DHS.

Chapter 07 - Applications

n  Section 07.20.50, Programs Overlap.

Deletes references to MinnesotaCare major program XX.

Chapter 15 - Insurance and Third Party Liability

n  Section 15.20, Creditable Coverage.

Updates contact information for clients or workers to request a Certificate of Creditable Coverage (COCC). This information was first announced in MAXIS e-mail #7200644 dated March 29, 2007.

Chapter 19 - Assets

n  Section 19.25.35.20, Special Needs Trust.

Corrects policy for pooled trusts for disabled people by removing the statement, "The client must be under age 65." This statement was added in error; age is not a criterion for consideration of this type of special needs trust.

Chapter 20 - Income

n  Section 20.25.30, RSDI and SSI.

Makes minor clarifications to the text under SSI and deletes an example.

Clarifies that for both MA Method A and Method B, the full RSDI payment received by a representative payee is counted as available regardless of whether the representative payee actually distributes the funds.

Clarifies that RSDI benefits are not counted for children on TEFRA or the home- and community-based waivers.

Chapter 28 - Health Care Service Delivery

n  Section 28.10.10, Managed Care Delivery Systems.

Removes reference to some managed care enrollees in Cass, Crow Wing, Morrison, Todd, and Wadena counties receiving dental services through fee-for-service. As of January 1, 2007, health plans cover dental services in these counties as well.
