Manual Letter #32

This manual letter lists new and revised material for the Health Care Programs Manual (HCPM). Unless otherwise noted, new and revised instructions are effective March 1, 2010.

Chapter 03 - Eligibility Groups and Bases of Eligibility.

Updates made to this chapter include incorporating bulletins #09-21-08, Certain 2009 Legislative Changes to Medical Assistance (MA) and #09-21-10, Changes to Citizenship Documentation Requirement for Medical Assistance and MinnesotaCare for Families with Children.  

Chapter 07 - Applications.

Changes to this chapter include incorporating bulletin #08-21-03, DHS Introduces the Minnesota Application Agent (MNCAA) Program.

Chapter 11 - Citizenship and Immigration Status.

Changes to this chapter include incorporating bulletin #09-21-10, Changes to Citizenship Documentation Requirement for Medical Assistance and MinnesotaCare for Families with Children.

Chapter 03 - Eligibility Groups and Bases of Eligibility

l  Section 03.20.10 - MinnesotaCare for Auto Newborns.

n  Incorporates bulletin #09-21-10, Changes to Citizenship Documentation Requirements for Medical Assistance and MinnesotaCare for Families with Children.

n  Clarifies that citizenship and identity documentation is not required for auto newborns.  

l  Section 03.20.15 - MinnesotaCare for Children Under 21.

Clarifies that children under 21 must follow citizenship verification requirements.    

l  Section 03.20.20 - MinnesotaCare for Adults with Children.

Clarifies that parents and relative caretakers who are citizens must follow citizenship verification requirements.    

l  Section 03.25.05 - Medical Assistance for Pregnant Women.

n  Clarifies that no verifications are required for auto newborns, including verification of citizenship and identity.    

l  Section 03.25.15 - Medical Assistance for Children Under 21.

Clarifies that children under 21 must follow citizenship verification requirements.    

l  Section 03.25.35 - Transitional MA/Transition Year MA.

Clarifies to follow standard MA guidelines for this group of enrollees, with an exception that if a TYMA enrollee is a sponsored noncitizen, do not deem income from the sponsor during the TYMA eligibility period.    

l  Section 03.45.05 - Emergency Medical Assistance (EMA).

n  Incorporates bulletin #09-21-08, Certain 2009 Legislative Changes to medical Assistance (MA).

n  Clarifies when pregnant noncitizens may be eligible for EMA.

Chapter 07 - Applications

l  Section 07.05 - How to Apply.

Adds information on ways county agencies, MinnesotaCare Operations, Minnesota Community Application Agents, and Application Assistors may help clients with the application process.

l  Section 07.10 - Where to Apply.

Deletes reference to bulletin #08-21-03 and instead links to the new MNCAA page.

l  Section 07.15 - Who May Apply.

Adds information on MNCAA from bulletin #08-21-03.

l  Section 07.15.20 - MNCAA Program (New).

Adds procedures for MNCAA from bulletin #08-21-03.

l  Section 07.20.05 - Date of Application.

Clarifies that MNCAAs can set the date of application for Minnesota Health Care Programs.

Chapter 11 - Citizenship and Immigration Status

l  Section 11.05 - Verification of U.S. Citizenship.

n  Incorporates bulletin #09-21-10.

n  Clarifies that auto newborns do not need to verify citizenship or identity at any time.

n  Clarifies verification process for all clients.

l  Section 11.05.05 - Acceptable Documentation of U.S. Citizenship and Identity.

Clarifies that level 4 documentation, on its own, is sufficient to verify citizenship.

l  Section 11.05.10 - Process for Documentation of U.S. Citizenship and Identity.

Updates the process for documenting citizenship and identity to clarify that clients that claim U.S. citizenship and who meet all other eligibility requirements should be approved immediately and the request for verification of citizenship and identity sent after approval.

l  Section 11.05.15 - Cooperation and Documentation Requirements.

Updates information regarding clients’ requirements to be considered cooperating with requests for citizenship and immigration documents.

l  Section 11.10 - Verification of Immigration Status.

Deletes ”For MinnesotaCare” to clarify that the forms to request proof of immigration status may be used for all programs.

l  Section 11.25 - Federally or State-funded Health Care.

Explains that people who entered the United States on or after August 22, 1996, and reside in the United States for at least five years in a qualified status may qualify for MA or MinnesotaCare back to the first day of the month in which they meet the five-year requirement.

Other Updates

Chapter 20 - Income

n  Section 20 - Income.

Clarifies that MA-EPD uses gross income, except for self-employment. MA-EPD self-employment uses net income to determine if a client has income at or below the income limit.

n  Section 20.10 - Verification of Income.

m Adds statement to clarify that verification of end of employment or stop work is not required for MinnesotaCare.

m Clarifies that self-employed households must submit all W-2s along with their taxes in order to verify their income.

n  Section 20.25.20.05 - MinnesotaCare Self-Employment.

Clarifies that W-2s are a required part of the form 1040 U.S. Individual Income Tax Return for purposes of verifying self-employment income.

n  Section 20.30 - Income Changes.

Adds statement to clarify that verification of end of employment or stop work is not required for MinnesotaCare.

Chapter 23 - MA Payment of Long-Term Care (LTC) Services

n  Section 23.15.10 - Deductions from LTC Countable Gross Income.

m Deletes Medical Expense information and adds a link to bulletin #10-21-04, "Modified Requirements for the Medical Assistance (MA) Deduction for Medical Expenses in the Long-Term Care (LTC) Income Calculation."

m Clarifies information by listing the Remedial Care Expense deduction separately from the Medical Expense deduction.
