Manual Letter #35

This manual letter lists new and revised material for the Health Care Programs Manual. Unless otherwise noted, new and revised instructions are effective June 1, 2010.

Chapter 03 - Eligibility Groups and Bases of Eligibility.

Updates to this chapter clarify the MA-EPD employment definition.

Chapter 09 - Mandatory Verifications.

Incorporates bulletin #09-03-08, "Minnesota to Participate in the Public Assistance Reporting Information System (PARIS) Interstate Match Program."

Chapter 11 - Citizenship and Immigration Status.

Updates include the addition of T and U visa holders and clarifications regarding nonimmigrant people and Afghan and Iraqi Special Immigrants.

Chapter 13 - State and County Residence.

Clarifies address verification and the Public Assistance Reporting Information System (PARIS).

Chapter 15 - Third Party Liability (TPL).

Updates examples to reflect July 1 premium changes.

Chapter 16 - Medical Support.

Annual updates made to the section on computing parental fees.

Chapter 22 - Standards and Guidelines.

Annual updates made to the section on Statewide Average Payment for Skilled Nursing Facility (SAPSNF) care.

Chapter 25 - Premiums.

The address for mailing initial MA-EPD premiums has changed.

Chapter 29 - Quality Assurance.

Incorporates bulletin #09-03-08, "Minnesota to Participate in the Public Assistance Reporting Information System (PARIS) Interstate Match Program."

Glossary.

Updates the definition for nonimmigrant.

Chapter 03 - Eligibility Groups and Bases of Eligibility

l  Section 03.30.20.05 - MA-EPD Employment Definition.

Additions made to this section clarify self-employment.

Chapter 09 - Verification Requirements

l  Section 09.05 - Mandatory Verifications.

Require verification of residency for cases involving a PARIS match.

Chapter 11 - Citizenship and Immigration Status

l  Section 11.20 - Federally Funded Health Care.

Adds Afghan and Iraqi Special Immigrants to the list of those who qualify for federally funded health care.

l  Section 11.20.20 - Cuban/Haitian Entrants.

Provides additional information on federal funding for Cuban/Haitian Entrants.

l  Section 11.25 - Federally or State-Funded Health Care.

Removes Afghan and Iraqi Special Immigrants from those who may or may not qualify for federal funding. Immigrants with this status do qualify for federal funding.

l  Section 11.25.20 - Afghan and Iraqi Special Immigrants.

Describes federal funding for Afghan and Iraqi Special Immigrants. Afghan and Iraqi Special Immigrants are considered refugees and therefore not subject to the five-year bar from federal funding. They are eligible for federally funded Medical Assistance.   

l  Section 11.30.05 - Other Lawfully Present Noncitizens.

Updates the Status Descriptions and Verification Requirements to include information on nonimmigrants with T and U visas. The T nonimmigrant status protects victims of human trafficking and the U nonimmigrant status protects victims of crimes who have suffered substantial mental or physical abuse.

Updates to this section clarify the definition of nonimmigrant.

Chapter 13 - State and County Residence

l  Section 13.05 - State Residence for Medical Assistance (MA) / MinnesotaCare Families.

l  Section 13.10 - State Residence for GAMC and GHO.

l  Section 13.15 - State Residence for MinnesotaCare Adults Without Children.

These sections clarify that receipt of a Public Assistance Reporting Information System (PARIS) Interstate Match requires verification of state residence.

Chapter 15 - Third Party Liability (TPL)

Examples updated to reflect July 1 premium changes.
