Manual Letter #41

This manual letter lists new and revised material for the Health Care Programs Manual. Unless otherwise noted, new and revised instructions are effective February 1, 2011.

This manual letter incorporates bulletins #10-14-01, “HIV/AIDS Programs (Program HH) Update” and #10-21-09, “Legislative Changes to MA Eligibility for Certain Noncitizen Children and Pregnant Women."

This manual letter incorporates the sections of bulletin #10-21-06, "2010 Legislative Changes to GAMC,” that announced the end of the GAMC Hospital Only (GHO) and Transitional MinnesotaCare programs. References to these two programs are removed from all sections within the manual. Please note that other sections of bulletin #10-21-06 that describe GAMC eligibility and program changes have not been incorporated. For the most current policy information regarding the GAMC program, continue to reference bulletin #10-21-06, as well as bulletins #10-21-07, “Legislative Changes to GAMC Effective June 1, 2010,” #10-21-16, “DHS Provides Updates on GAMC Reform Including Impacts on MinnesotaCare,” and #10-21-19, “Changes to GAMC Eligibility.”

Chapter 03 - Eligibility Groups and Bases of Eligibility

Incorporates bulletin #10-21-09. Also clarifies the start dates for SLMB.

Chapter 04 - Social Security Administration Benefits

Clarifies the annual election period for Medicare and introduces the Part C disenrollment period.

Chapter 11 - Citizenship and Immigration Status

Incorporates bulletin #10-21-09.

Chapter 15 - Third Party Liability

Clarifies that health care coverage available to adults age 21 and over through a parent’s employer is not considered Employer-Subsidized Insurance (ESI).

Chapter 22 - Standards and Guidelines

Updates the IRS mileage rate to 51 cents per mile for 2011.

Chapter 15 - Third Party Liability (TPL)

Clarifies that workers should not request information from adults age 21 and over about health care coverage they may have available through their parents.

Clarifies that health care coverage available to an adult age 21 and over through a parent’s employer plan is not considered ESI and workers should not verify potential access to this coverage.

Adds example to clarify that adults age 21 and over with insurance available through a parent's employer are not required to provide information about the insurance since they cannot enroll in it on their behalf.

Clarifies that an MA enrollee cannot be closed for failure to cooperate with enrolling an adult child in their employer's health plan.
