The Disabled Widow and Widower Disregard is only available to MA Method B and the Medicare Savings Programs.
To use the Disabled Widow/Widower Disregard, the client must meet all of the following conditions:
l They are currently receiving either:
n RSDI Disabled Widow/Widower benefits.
n Disabled Surviving Divorced Spouse benefits.
l They received SSI and/or MSA benefits the month before the month they began receiving RSDI Disabled Widow/Widower or Disabled Surviving Divorced Spouse benefits.
l They lost SSI and/or MSA eligibility on or after January 1, 1991 due to receipt of RSDI Disabled Widow/Widower or Disabled Surviving Divorced Spouse benefits.
l If their RSDI income were disregarded, their remaining income would be at or below the current SSI or MSA benefit rate.
l They are not entitled to Medicare Part A.
Note: The client should be instructed to notify the worker when a notice of Medicare Part A eligibility is received from Social Security Administration (SSA) .
Disregard the RSDI benefits of clients who meet all of the conditions.
Note: Calculate a client’s counted income with all other income the client receives, after taking into account all other disregards and deductions.
This disregard ends the first full month the client is eligible for Medicare Part A.
Note: The months the client collected SSI or MSA are credited toward the 24-month Medicare waiting period.
